Es wird der Rechtsrahmen der guten fachlichen Praxis im Pflanzenschutz mit den rechtlichen Bezügen dargestellt. Der Zweck und Inhalt der Veröffentlichung, Grundsätze der guten fachlichen Praxis im Pflanzenschutz, zeigt, dass die Bekanntmachung der Grundsätze der geeignete Weg für eine Verhaltenssteuerung bei der Durchführung von Pflanzenschutzmaßnahmen ist. Eine andere Rechtsverbindlichkeit ist wegen der möglichen Einzelfallregelung gem. § 6 Abs. 1 Satz 3 Pflanzenschutzgesetz (PflSchG)1 nicht erforderlich, es sei denn der europäische Gesetzgeber macht in seiner beabsichtigten Novellierung der Richtlinie 91/414/EWG2 erweiterte Vorgaben, die einer Umsetzung in das nationale Recht bedürfen. ; The legal frame of the good technical practice in plant protection is shown in context with the legal references. The aim and contents of the publication "Principles of the Good Technical Practice in Plant Protection'' shows that the publication of the principles is the right way for a behaviour management in carrying out plant protection measures. More legal binding is not necessary because of the feasible regulation in individual cases acc. to § 6, par. 1, sentence 3 of the Plant Protection Law (PflSchG) unless the European legislator extends the requirements in the intended amendment of the Directive 91/414/EC which needs implementation into national legislation.

Die Richtlinie 91/414/EWG, die die Prüfung, den Vertrieb und die Anwendung von Pflanzenschutzmitteln in der Europäischen Union regelt, ist am 15. Juli 1991 nach langjährigen Diskussionen vom Rat der Europäischen Union verabschiedet worden. Fast 10 Jahre nach Inkrafttreten der Richtlinie erscheint es angemessen, das Erreichte zu überprüfen und zu bewerten. Aufgrund der Richtlinie sind die Mitgliedstaaten verpflichtet, Unterlagen und Datenanforderungen für einen Antrag auf Zulassung eines Pflanzenschutzmittels auf der Grundlage der Anhänge II und III der Richtlinie zu fordern. Die Mitgliedstaaten sind weiterhin verpflichtet, eine Bewertung der Unterlagen nach Anhang VI der Richtlinie vorzunehmen. Die Anhänge der Richtlinie sind auf der Basis des Standes von Wissenschaft und Technik verabschiedet worden. Seit 1997 sind aber die Anhän ae nicht mehr geändert worden. Die Kommission muss deshalb Tendenzen begrenzen, durch nationale Sonderregelungen die gegenseitige Anerkennung der Zulassungen (Artikel l 0) zu erschweren. Das Hauptaugen.merk richtet sich auf die Erfolge bei der gemeinschaftlichen Uberprüfung der rund 800 Altwirkstoffe, die vor dem 26. Juli 1993 im Bereich der EU-Mitgliedstaaten auf dem Markt waren. Die l. Stufe des Programms zur Überprüfung von 90 Altwirkstoffen wurde mit der Verordnung (EWG) Nr. 3600/92 der Kommission vom 11. 12. 1992 eingeleitet. Diese Arbeiten dauern zur Zeit noch an. Ursprünglich war geplant, jährlich 90 Altwirkstoffe zu überprüfen. Mit Stand 31. Dezember 2000 sind jedoch erst 7 Altwirkstoffe und 5 neue Wirkstoffe in Anhang I (Positivliste) aufgenommen. Für 15 Wirkstoffe wurde eine Entscheidung über die Nichtaufnahme getroffen bzw. die betreffenden Zulassungen widerrufen. Trotz dieser Verzögerungen sind inzwischen die 2. und 3. Stufe der Altwirkstoffprüfung mit ehrgeizigem Zeitplan eingeleitet worden. Gemäß Verordnung (EG) Nr. 451/2000, die am 1. März 2000 in Kraft trat, waren 148 Wirkstoffe der 2. Stufe der Prüfung bis 1. September 2000 zu notifizieren. Bis zum 1. Dezember 2000 haben die Hersteller der ca. 440 noch verbleibenden Altwirkstoffe (3. Stufe) mitzuteilen, ob sie die Wirkstoffe weiterhin verteidigen wollen. Die BBA ist von der Europäischen Kommissio? mit der Prüfung dieser Mitteilungen (Notifizierungen) beauftragt (RENDER = Review of EU Notifications under Directive 91/414/EEC and Related Regulations). Ca. 150 Wirkstoffe aus verschiedenen Wirkstoffkategorien wurden mit der Verordnung (EG) No. 451/2000 (Anhang II) vorläufig von der Uberprüfung ausgenommen. Die Gründe sind vielfältig, z.B. Überschneidung mit Bioziden, "Low-Risk"-Produkte, fehlende Prüfanforderung. Nach vorsichtigen Schätzungen werden etwa 200 Altwirkstoffe die strengen Prüfungen nach EU-Maßstab bestehen. Dies bedeutet für viele Mitgliedstaaten eine Ausdünnung der Wirkstoffpalette. Der Anbau von Kulturen mit geringem Anbauumfang ist davon besonders betroffen. Die Hoffnung richtet sich deshalb auf die Erforschung und Anmeldung neuer Wirkstoffe. Nach Angaben der Europäischen Kommission wurden bisher für 78 Wirkstoffe Anträge auf Aufnahme in Anhang I gestellt (Dezember 2000). Mit dem Beschluss der Europäischen Kommission, eine European Food Authority (EFA) zu gründen und ihr auch wesentliche Aufgaben zur Wirkstoffprüfung zu übertragen, wird ein neues Kapitel im Bemühen um Harmonisierung im Pflanzenschutz eingeleitet. ; After many years of discussions, Directive 91/414/EEC regulating the evaluation, distribution and use of plant protection products in the European Union was passed on the 15th of July 1991 by the Council of the European Union. Nearly 10 years after the enforcement of the Directive, it seems appropriate to examine and evaluate our achievements. In conformity with Annexes II and III to the Directive, Member States are obliged to claim documents and data required to apply for the authorisation of a plant protection product. Member States are moreover obliged to evaluate these documents, according to Annex VI of the Directive. The Annexes to the Directive were enacted on the basis of the current state of scientific research and technological development. However, since 1997 these Annexes have not been amended. Therefore, the Commission has to confine tendencies to establish special national rules which make the mutual recognition of authorisations (Article 10) very difficult. Particular attention is paid to the results achieved in the joint review of approximately 800 existing active substances which were on the market in EU Member States before the 26th of July 1993. The first stage of the evaluation program for 90 existing active substances was initiated by Cornmission Regulation (EEC) No 3600192 issued on the llth of December 1992. This work is still in progress. The original plan was to review 90 existing active substances per year. By the 3lst of December 2000 however, only 7 existing active substances and 5 new active substances had been included in Annex J (positive !ist). It was decided not to include 15 acti ve substances and to withdraw their relevant authorisations. Despite these delays, the second and third stage of reviewing existing active substances started with an ambitious schedule. Regulation (EC) No 451/2000 enforced on the l" of March 2000 required the notification of 148 active substances by the !" of September 2000 during the seconcl stage of the review. By the l" of December 2000, the manufacturers of the approximately 440 remaining existing active substances (third stage) had to give notice of whether or not they still wished to defend them. The BBA has been entrusted with the evaluation of these notifications (RENDER = Review of EU Notifications under Directive 91/414/EEC and Related Regulations) by the European Commission. About 150 active substances from various categories are temporarily excluded from the review on the grounds of Regulation (EC) No 45112000 (Annex II). The reasons are manifold, for example, an overlapping with biocicles, "low-risk" products and missing evaluation requirements. According to cautious estimates approximately 200 existing active substances will pass the rigorous exarninations in conformity with EU standards. This means for many Member States a shrinking range of active substances which will especially affect the cultivation of minor crops. Hopes are therefore pinned on research and the registration of new active substances. As per statement of the European Conunission, 78 applications for an inclusion in Annex I have been made up to now (December 2000).
